Terms of Service
These Terms of Service (“Terms”) govern your use of WiseAddress (the “Service”), operated by Upgiant (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What WiseAddress is
WiseAddress aggregates public and licensed data (for example environmental, tax, and land-use records) and produces an informational summary and an estimated grade for a property address, tailored to a household profile you provide. The Service is an informational research tool. It is not a real-estate broker, lender, appraiser, inspector, insurer, or law firm, and it does not provide professional advice of any kind. 2. Eligibility and your account
You must be at least 18 years old and able to form a binding contract. We use passwordless sign-in: you receive a one-time link by email. You are responsible for the security of the email account you sign in with and for activity under your account. Tell us promptly if you believe your account has been accessed without authorization.
3. Acceptable use
You agree not to:
- scrape, resell, or redistribute the Service’s data or reports except as expressly permitted;
- use the Service to violate any law or any third party’s rights;
- attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or
- use the Service to make decisions about a person’s eligibility for credit, insurance, housing, or employment (the Service is not a consumer reporting agency and its output is not a consumer report under the Fair Credit Reporting Act).
4. Data sources and accuracy
Reports are built from third-party and government data that may be incomplete, outdated, or wrong, and from probabilistic models that can misclassify. We do not warrant the accuracy or completeness of any report. You are responsible for independently verifying anything that matters to your decision, including with qualified professionals.
5. Fees
Pricing, if any, will be presented to you before you incur a charge. We may change features and pricing prospectively. Where required, changes take effect only after notice.
6. Intellectual property
The Service, including its software, design, and report presentation, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial property research.
7. Disclaimers and limitation of liability
The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any decision you make based on a report. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service or your violation of these Terms.
9. Changes; termination
We may update these Terms; material changes will be posted here with a new version, and continued use after the effective date means you accept them. You may stop using the Service at any time, and you may delete your account from your settings.
10. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Venue for any dispute lies in the state or federal courts located in Florida.
